“would allow roughly 100 new oil and gas leases to move forward in these pristine areas. ” is not strictly speaking accurate. Those leases are the gap leases that Mr. King refers to. They were already leased at a time the 2001 rule was not in effect (from 2001 to 2006) so are not “new” leases. With LaPorte's decision the current status quo is that those leases would be developed with roads, if not for the agreement between the FS and the State of Colorado. So the Colorado Rule does not affect their status except to the extent that they may be MORE protected than under the status quo, based on the final rule.
